Statute of Limitations

  • 4 years with Discovery Rule. (Wyo. Stat. Ann. §1-3-105)
  • Medical malpractice – 2 years from act, error, or omission or two years after discovery, where claimant failed to discover the alleged act, error, or omission within the two year period despite due diligence.  Minors must bring claim by eighth birthday or within 2 years of act or omission, whichever period is greater.  Claimants with a legal disability must bring suit within 1 year from removal of disability. (Wyo. Stat. Ann. §1-3-107)

Bloomberg reported that more than 90 percent of U.S. nursing homes in each of the past three years were cited for violating federal standards, according to a government report.  The article substantiates that many nursing homes are simply not doing an adequate job caring for our nations elderly population.  According to the inspector general's report for the Department of Health and Human Services:

I had to do a double-take when I saw some nursing home staffing statistics referenced in a report released by the Office of the Inspector General (OIG).  An alarming 92% of nursing homes across the country have at least one criminal-- in one form or another-- working at the facility.

In calculating this disturbing statistic, 260 nursing homes were randomly selected from the almost 16,000 nursing homes that receive Medicare funding.  Lists of current employees were then compared with data from FBI criminal records.
